Terms of Service - Adapteki

1. Agreement to Terms

By accessing or using Adapteki ("Service"), operated by Adapteki ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date and, where appropriate, notifying you through the Service or by email. Your continued use of the Service after any changes indicates your acceptance of the new Terms.

2. Description of Service

Adapteki is an adaptive learning platform designed to help users prepare for the Japanese Language Proficiency Test (JLPT). The Service provides:

Spaced repetition-based study sessions
Vocabulary, grammar, and kanji practice questions
Progress tracking and exam readiness metrics
Personalized learning based on your performance

The Service is intended for educational purposes only. While we strive to provide accurate and helpful study materials, we do not guarantee that using our Service will result in passing the JLPT or any other examination.

3. Account Registration

To use certain features of the Service, you must create an account. You may register using:

Email and password
Third-party authentication providers (Google, Apple, Facebook, WeChat, Kakao, LINE)

When creating an account, you agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Promptly update any changes to your information
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized access

You must be at least 13 years old (or 16 in the European Economic Area) to create an account and use the Service.

4. Third-Party Authentication

If you choose to register or sign in using a third-party authentication provider (such as Google, Apple, Facebook, WeChat, Kakao, or LINE), you authorize us to access certain information from that provider as described in our Privacy Policy.

Your use of third-party authentication is also subject to the terms and privacy policies of those providers. We are not responsible for the practices of third-party authentication providers.

5. Acceptable Use

Interfere with or disrupt the integrity or performance of the Service

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Adapteki and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial educational purposes. This license does not include the right to:

Modify or copy our materials
Use materials for commercial purposes
Reverse engineer any software contained in the Service
Remove any copyright or proprietary notations

7. User Content

Any content you submit to the Service (such as feedback, suggestions, or study notes) remains your property. However, by submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content in connection with operating and improving the Service.

You represent that you own or have the necessary rights to submit any content and that such content does not infringe upon the rights of any third party.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

The Service will meet your specific requirements
The Service will be uninterrupted, timely, secure, or error-free
The results from using the Service will be accurate or reliable
Any errors in the Service will be corrected
Use of the Service will result in passing any examination

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ADAPTEKI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to or use of (or inability to access or use) the Service
Any conduct or content of any third party on the Service
Any content obtained from the Service
Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for all claims arising from or relating to the Service shall not exceed the amount you paid us, if any, during the twelve (12) months preceding the claim.

14. Indemnification

You agree to defend, indemnify, and hold harmless Adapteki and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

Your access to or use of the Service
Your violation of these Terms
Your violation of any third-party rights
Any content you submit to the Service

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Adapteki operates, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Adapteki regarding your use of the Service and supersede any prior agreements between you and us relating to the Service.
